Buggy & Go offers recreational rental services of buggies, four-wheelers (ATVs), and golf carts for leisure use at the Causeway of Amador, Panama.

2. Eligibility and Requirements

To rent or operate a vehicle from Buggy & Go, you must:

• Be at least 18 years old or the legal driving age in Panama, whichever is higher.
• Present a valid driver’s license.
• Agree to comply with all local traffic, safety, and public order laws.
• Accept full responsibility for the vehicle and all passengers during the rental period.

Buggy & Go reserves the right to refuse service to any customer who does not meet these requirements or who behaves in a manner deemed unsafe, inappropriate, or risky.

3. Rental Terms

• The rental period begins and ends according to the time agreed upon at the time of booking.
• Vehicles must be returned in the same or better condition, cleanliness, and working order as when delivered.
• Late returns may result in additional charges for extra hours or fractions thereof.
• Negligent, reckless, or illegal use of the vehicle is strictly prohibited.
• Safety equipment, when applicable (helmets, seat belts, harnesses, and any other safety gear), must be used as instructed by authorized staff.

4. Payments and Cancellations

• Payment must be made in full before the rental period begins.
• Accepted payment methods include cash, credit/debit cards, or other methods specified by Buggy & Go.
• Cancellations must be made at least 24 hours in advance in order to receive a refund.
• No refunds will be issued for:
  • No-shows (“no show”),
  • Early returns,
  • Partial use of the service.

5. Risk Acknowledgment, Liability and Damages

5.1 Risk Acknowledgment

By renting and/or operating a vehicle from Buggy & Go, the undersigned (the “Client” or “Renter”) declares and agrees as follows:

1. I speak and understand English or Spanish perfectly (as applicable).
2. I have been duly informed and acknowledge that the use of a rental vehicle involves inherent risks, which may include, but are not limited to:
   • Loss of control and falls;
   • Accidents or collisions that may cause personal injury, damage to third parties and/or property, or, in extreme scenarios, death;
   • Risks associated with weather conditions, road, terrain, and surroundings.
3. I am in good physical and mental condition, and I declare that I do not suffer from any illness or condition that would prevent me from safely operating the vehicle. I am not under the influence of alcoholic beverages, drugs, or any substance that may alter or impair my motor, sensory, or cognitive abilities.
4. I assume full responsibility for any type of damage caused with the vehicle, whether to the vehicle itself, to third parties, or to property.
5. I agree that I must not transport third parties in the vehicle unless they are expressly authorized or registered with Buggy & Go as passengers.
6. I agree that I must not allow anyone other than the declared and authorized driver(s) to use or operate the vehicle.
7. I acknowledge that I have received the vehicle in good working and clean condition.
8. I confirm that I have not handed over any valuable objects, travel items and/or luggage to any person other than staff members duly identified as authorized personnel of Buggy & Go.
9. I understand that the risks associated with the use of the vehicle vary depending on weather and terrain conditions, and I agree to operate the vehicle responsibly.
10. I am responsible for the proper use, operation, custody, and transportation of the vehicle, as well as compliance with traffic rules, applicable laws, and these terms and conditions. I further agree not to drive negligently or recklessly, to avoid unintentional damage, and not to use the vehicle for illegal purposes.

5.2 Client Obligations and Responsibilities

Consequently, the Client further declares, acknowledges, and agrees as follows:

• (A) Responsibilities:
  • To review the general condition of the vehicle in accordance with Buggy & Go’s rules and instructions; and
  • To take all precautionary measures within their reach to prevent, avoid, mitigate, or minimize any risks arising from the use of the vehicle.
• (B) Third-Party Use: Not to allow anyone other than the declared and authorized driver(s) to use the vehicle, nor to assign, sublease, or transfer the vehicle to third parties.
• (C) Loss or Theft: To be fully liable for the loss of the vehicle if it is stolen, misappropriated, or otherwise unlawfully taken during the rental period, and for any damage the vehicle may suffer. In case of total loss, the amount of the loss will be determined by deducting ordinary depreciation from the purchase value of the vehicle, as determined by Buggy & Go.
• (D) Return Condition: To return the vehicle as a guarantee in the same or better condition as received. This does not include additional charges for extra hours, if any, which will depend on the agreed schedule, nor damage caused by collisions or impacts, damages to parts, components, or accessories, which shall be charged separately as applicable.
• (E) Damage Charges: In the event of damage, I accept and agree to pay the valuation made by Buggy & Go within the following ranges, depending on the type of vehicle:
  • Fourwheeler (ATV): minimum USD $150.00 and maximum USD $600.00
  • Buggy: minimum USD $300.00 and maximum USD $1,200.00
  • Golf cart: minimum USD $400.00 and maximum USD $1,700.00

5.3 Liability and Insurance

• The renter is responsible for any damages to the vehicle, to third parties, or to property caused during the rental period.
• Buggy & Go is not liable for accidents, injuries, loss, theft, or damage to the renter’s or passengers’ personal belongings.
• Some vehicles may include limited insurance coverage; details, if applicable, will be provided before the rental begins.
• Renters are advised to operate the vehicle responsibly and follow all safety recommendations given by staff or indicated on signage, printed materials, or the website.

6. Safety and Conduct

• The use or operation of vehicles under the influence of alcohol or drugs is strictly prohibited.
• Only the registered and authorized renter(s) may operate the vehicle.
• Reckless driving, racing, stunts, or using the vehicle in off-limit or prohibited areas may result in the immediate termination of the rental without refund.
• Users must respect pedestrians, cyclists, and other vehicles on the road at all times.

Buggy & Go reserves the right to immediately terminate the rental without refund in case of breach of safety rules or inappropriate or dangerous conduct.

7. Website Use and Privacy

By using our website, you agree not to engage in any activity that could damage, overload, interfere with, or hinder its normal operation.

Buggy & Go values your privacy and handles your personal data in accordance with applicable data protection laws. We only use your information to manage reservations, payments, and to provide customer service and communications related to our services.

8. Modifications to These Terms

Buggy & Go reserves the right to modify or update these Terms and Conditions at any time. Updates will be published on this page and will take effect immediately upon posting. Continued use of the website or services after such changes shall be deemed as acceptance of the updated terms.

9. Governing Law and Jurisdiction

These Terms and Conditions are governed by the laws of the Republic of Panama.

Any dispute arising from the use of our services or website shall be subject to the exclusive jurisdiction of the competent courts of Panama City, Panama.

10. Interpretation

For purposes of interpretation, words in the singular shall include the plural and vice versa. Terms in the masculine shall include the feminine and vice versa, whenever the context so requires.
